The New Mexico Supreme Court has imposed sanctions on lawyer Stephen Aarons for using AI-generated fabricated witnesses and false police statements in a murder case appeal. The court fined the lawyer $5,000 for failing to verify the accuracy of the documents he submitted. The court found that the case documents contained entirely fabricated witness statements and false information about the attacker’s clothing and appearance. Lawyer Aarons admitted that he believed the summary he prepared using ChatGPT during the court proceedings would be flawless.

The court stated that the lawyer acted with the expectation of presenting a bulletproof summary in court, but neglected his basic legal responsibilities in the process. This situation constitutes a striking example of the uncontrolled use of AI tools in the legal world.

Events During the Court Proceedings

In a hearing held in August, Judge C. Shannon Bacon questioned how the lawyer could have been unaware of the risks posed by the use of artificial intelligence. Judge Bacon asked the lawyer if he kept up with world events, reminding him that AI hallucinations were now a daily news item.

According to court records, ChatGPT, which the lawyer hoped would create a bulletproof summary, actually generated entirely fictitious data. This constitutes a significant example of the uncontrolled use of AI tools in the legal world.

Lawyer Stephen Aarons told Reuters that he regretted his actions and hoped the disciplinary panel would consider it a genuine mistake. Aarons had to face the consequences of presenting AI-generated information to the court without verifying it.
